SC issues notice to NHRC on fake encounters
The Supreme Court on Monday issued a notice to the National Human Rights Commission (NHRC) on a petition seeking framing of proper guidelines to check fake encounters by the police.
A Bench headed by Chief Justice YK Sabharwal sought NHRC's assistance while dealing with a petition by one R Chanderashekhar Reddy of Medak in Andhra Pradesh, who alleged large scale killings of innocent people in Andhra Pradesh by the state police in fake encounters to get out-of-turn promotions.
The court has already issued notices to the Centre and the state governments on the issue.
Appearing for the petitioner, senior counsel Rajiv Dhavan submitted that the NHRC had issued guidelines on the issue way back in 1997 but the same was not implemented.
He questioned the legality of a government order, which provided for out-of-turn promotions for police personnel posted in terrorist or naxal-infested areas if they killed terrorists or naxalites.
Dhavan submitted that the issue was important as it was not limited to just Andhra Pradesh and Jammu-Kashmir and North-Eastern stated were also witnessing similar incidents.
